Partner Terms

These Partner Terms apply to every professional partner account on Picsui: photographers, planners, venues, DJs and event organizers who buy event credits and run Picsui events for their own clients. They sit on top of the Terms of Service and the Privacy Policy, which continue to apply to you, to your clients and to every guest. Where these Partner Terms and the Terms of Service differ, these Partner Terms win for partner accounts only.
1. You are an independent business
A partner is an independent business. Nothing in the partner program creates an employment, agency, franchise, joint venture or partnership relationship in the legal sense between you and Picsui. You set your own hours, your own prices and your own client relationships, and you are responsible for your own taxes, licences and insurance.
2. You do not represent Picsui
You are not an agent, employee, spokesperson or representative of Picsui, and you have no authority to act for Picsui, to make promises on its behalf or to bind it to anything. In particular, you must not:
- describe yourself or your business as Picsui, as part of Picsui, or as an authorized or official Picsui agent, dealer or representative;
- make promises about the service that go beyond what is published on picsui.com, including uptime, retention, features, limits or pricing;
- sign anything, accept any liability or settle any claim in Picsui's name;
- present Picsui as the operator of your event or as a party to your contract with your client.
You may say, truthfully, that your business uses Picsui to collect and share guest photos, and that you are a Picsui partner.
3. Your clients are yours
The contract for an event is between you and your client. Picsui is not a party to it. You decide what you charge your client, you invoice them, and you keep what you charge above the credit price. Picsui never bills your client for an event you run on a credit, and never pays you a commission on it.
You are responsible for your client relationship, including expectations, timelines, support during the event and any refund you owe your client. Picsui supports you; your client looks to you.
4. Event credits
- One credit runs one client event with the same inclusions as the consumer Event Pass: guest photo, video and voice uploads, the digital guestbook, the live slideshow, the live stream (up to 90 minutes and 100 concurrent viewers), original-quality downloads, and 365 days of hosting from the event date.
- Credits cost $19 each, $79 for five, or $249 for 20. Prices may change; the price shown at checkout is the price you pay. Credits you have already bought keep their inclusions.
- Credits expire 12 months after purchase, are tied to your partner account, and cannot be transferred, resold as credits or redeemed for cash.
- A credit is spent when you create a client event with it. A spent credit is not refundable. Unused credits follow the Refund Policy.
- The free first-event credit, and any podcast listener-code credit, are a gift from Picsui granted once per partner account when your first credit purchase is paid. They have no cash value and can be withdrawn if an account is found to be in breach of these terms.
5. What is not included
- Live streams beyond 90 minutes or 100 concurrent viewers per event. Recording of a live stream is a separate purchase where offered.
- Each event has a fair-use storage allowance of 25 GB. Uploads stop when it is reached. Photos are hosted for 365 days and then deleted, as described in the Terms of Service.
- Picsui does not provide on-site staff, equipment, printing or photography.
6. Branding and the Picsui name
You may put your business name and logo on the QR signs and the client gallery for events you run. Galleries are hosted on picsui.com. You may not remove, hide or alter Picsui legal notices, privacy links or the guest consent flow, and you may not register domains, social accounts or business names that include "Picsui" or anything confusingly similar. Picsui may use your business name and logo only to list you as a partner, and will stop on request.
7. Guests, content and the law
You and your client are responsible for telling guests that photos they upload are shared with the event host, for obtaining any consent your event or jurisdiction requires, and for the content guests upload at your events. The Terms of Service content rules apply to every upload. You must not use guest contact details collected through Picsui for anything the guest did not agree to, and you must honour deletion requests promptly.
8. No exclusivity, no minimums
You are free to use other tools and to work with other providers. Picsui is free to work with other partners, including partners in your area, and to sell directly to anyone, including your clients if they come to picsui.com on their own. There is no minimum purchase.
9. Suspension and termination
Either side can end the partner relationship at any time. You keep access to events you have already created for their hosting period. Picsui may suspend or close a partner account without notice for misrepresentation of Picsui, abuse of the service, non-payment, or harm to guests, clients or other users. Unused paid credits on a closed account follow the Refund Policy; gift credits are forfeited.
10. Liability
To the fullest extent the law allows, Picsui's total liability to you for anything arising from the partner program is limited to the amount you paid Picsui for credits in the 12 months before the claim. Picsui is not liable to your clients or their guests for your acts or promises, and you agree to defend and indemnify Picsui against claims that arise from your representations, your client contracts, or your breach of these terms. The service is provided as described in the Terms of Service, and the warranty and liability sections there apply here too.
11. Changes
Picsui may update these Partner Terms. Material changes will be emailed to the address on your partner account at least 14 days before they take effect. Buying or spending a credit after that date is acceptance of the updated terms.
12. Everything else
Governing law, dispute resolution and the other general provisions of the Terms of Service apply to these Partner Terms. Questions go to Support@Picsui.com.
