DMCA & Copyright Policy

1. Overview

Picsui respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our service.

2. Reporting Copyright Infringement

If you believe that content available on or through Picsui infringes your copyright, please submit a DMCA takedown notice containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location on Picsui where the material can be found.
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

3. How to Submit a Notice

Send your DMCA takedown notice to our designated copyright agent:

You may also report copyright violations directly from any photo in a Picsui gallery by using the "Report" button and selecting "Copyright violation" as the reason.

4. Response to Valid Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly.
  • Notify the user who uploaded the content that it has been removed.
  • Provide the uploader with information about filing a counter-notification.

5. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

6. Repeat Infringers

Picsui will terminate the accounts of users who are determined to be repeat infringers. We may also terminate accounts at our sole discretion for even a single instance of infringement.

7. Good Faith

Please note that misrepresentations in a DMCA notice or counter-notification may result in liability for damages, including costs and attorney fees. Before filing a takedown notice, please consider whether the use of the material constitutes fair use.
