1. Acceptance of Terms

By accessing and using Picsui ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Picsui provides a QR-powered photo sharing platform for events. The Service allows event hosts to create events with unique QR codes that guests can scan to upload photos. Hosts can monitor uploads in real-time, moderate content, and download photos.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Picsui offers paid subscription plans (Basic and Pro). By subscribing, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide valid payment information
  • Authorize automatic recurring billing
  • Accept that fees are non-refundable except as required by law or as explicitly stated in our refund policy

5. User Content

You retain all rights to photos and content you upload to the Service. By uploading content, you grant Picsui a worldwide, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to upload the content
  • Your content does not violate any third-party rights
  • Your content does not contain illegal, harmful, or offensive material

6. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Upload content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems to access the Service without permission

7. Content Moderation

We use AI-powered moderation to automatically flag potentially inappropriate content. We reserve the right to remove any content that violates these Terms or is otherwise objectionable, with or without notice.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Picsui and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

10. Limitation of Liability

To the maximum extent permitted by law, Picsui shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
