Terms of Service

1. Acceptance of Terms

By accessing and using Picsui ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Picsui provides a QR-powered photo sharing platform for events. The Service allows event hosts to create events with unique QR codes that guests can scan to upload photos. Hosts can monitor uploads in real-time, moderate content, and download photos.

3. User Accounts

You must be at least 18 years old, or the age of majority where you live, to create an account or buy anything. Guests do not need an account. To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Picsui sells the one-time Event Pass, the Photographer Pro subscription, per-event Partner credits, the Stream Recording add-on, and sales-assisted Corporate pilots. If you are on an older plan we no longer sell, these terms continue to apply to it.

Photographer Pro is a subscription billed monthly ($39 a month) or annually ($349 a year). It renews automatically at the end of each billing period until you cancel. You can cancel at any time from the billing portal in your account; cancellation takes effect at the end of the current billing period, and you keep access until then. Refunds follow our Refund Policy.

By purchasing, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide valid payment information
  • Authorize automatic recurring billing when you choose a subscription, until you cancel it
  • Accept that one-time passes do not renew automatically
  • Accept that fees are non-refundable except as required by law or under our 30-day unused-event money-back guarantee

The full eligibility rules and request instructions are published in our Refund Policy. Cancelling a subscription stops future renewals; it does not automatically refund a billing period that has already started.

5. User Content

You retain all rights to photos and content you upload to the Service. By uploading content, you grant Picsui a worldwide, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to upload the content
  • Your content does not violate any third-party rights
  • Your content does not contain illegal, harmful, or offensive material

6. Event Guests and Minors

Hosts invite guests to add photos, videos and messages to their event. As a host, you are responsible for who you share the event with, for getting any permission needed to share photos of the people in them (including a parent's or guardian's permission for children), and for the content your guests add.

Guests who add content agree to these Terms for what they add. Picsui is not directed at children under 13, and children should take part in an event only with a parent's or guardian's supervision. If you believe a photo shows you or your child without permission, email us and we will work with the host to remove it.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Upload content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems to access the Service without permission

8. Content Moderation

Event hosts control what appears in their gallery: a host can require approval so uploads are held until the host reviews them, and can remove any photo or video at any time. Automated (AI) screening of uploads is not active, so uploads are not checked automatically before they appear unless the host requires approval. We reserve the right to remove any content that violates these Terms or is otherwise objectionable, with or without notice.

9. Live Streams and Recordings

Live streams need a working internet connection at the venue and are limited to 90 minutes and 100 viewers at a time per stream. Longer or larger streams need a written agreement.

We try to record every stream, but a recording is not guaranteed: a stream can fail or end early because of the venue's connection, the device used or a third-party service. The Stream Recording add-on is offered only for a stream that was recorded. A recording that is not unlocked is deleted after 30 days.

10. Photo Retention and Deletion

Photos, videos and messages are kept for the period your plan includes, as shown on our pricing page when you buy. Today, Free Preview photos are deleted 30 days after upload and an Event Pass keeps its gallery for 12 months. Download anything you want to keep before then.

Deleted content, whether removed by you, by the host or at the end of its retention period, is gone for good and cannot be restored, including by buying a plan afterwards. Backup copies are overwritten on their normal schedule.

11. Intellectual Property

The Service and its original content, features, and functionality are owned by Picsui and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

12. SMS Terms

Picsui offers an optional text-message program for event hosts ("Picsui event-day texts"). By entering your mobile number and ticking the opt-in box on your account or event page, you agree to receive automated text messages from Picsui at that number. Consent is not a condition of purchase.

  • What you receive: event-day notifications only: when guest uploads open for your event, when the first photo arrives, and a reminder if no photos have arrived after two hours.
  • Message frequency: up to 3 messages per event day. You will not receive texts on days you have no event.
  • Cost: Picsui does not charge for text messages. Message and data rates may apply from your mobile carrier.
  • Opting out: reply STOP to any message to cancel at any time; you will receive one final message confirming you have been unsubscribed. You can also untick the opt-in box on your account page.
  • Help: reply HELP to any message, email Support@Picsui.com, or visit picsui.com/sms.
  • Carriers: carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your network operator.
  • Your number: you confirm that you are the owner or authorised user of the mobile number you provide, and that you will tell us if you change it.

13. Referral and Partner Payouts

Some people earn a payout for referring customers with their own code, such as ambassadors and local partners. A payout is earned only on a paid Event Pass bought with that code. It becomes payable 30 days after the purchase and is not earned on purchases that are refunded, given away, or made by the code holder for themselves. We pay monthly by the method we agree with you.

You are responsible for any taxes on what you earn, and we may ask for tax information (such as a W-9) before paying. Codes may not be posted on coupon or deal sites. We may change or end a program or a code with notice; payouts already earned stay payable. Resellers who buy event credits follow our separate Partner Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

15. Indemnification

You agree to defend and indemnify Picsui against claims, losses and costs (including reasonable legal fees) that arise from content you or your event's guests upload, from your use of the Service, or from your breach of these Terms.

16. Limitation of Liability

To the maximum extent permitted by law, Picsui shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

17. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

19. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

Before starting a claim, please email us at Support@Picsui.com and give us 30 days to try to resolve it. Either of us may bring an eligible claim in small claims court.
